- Upon any conviction, an offender is required to participate and complete an alcohol or drug abuse screening program and, if necessary, a treatment program approved by the court. N. M. S. A. § 66-8-102(L).
- Upon a second or third conviction, an offender must participate in and complete: (1) not less than a 28-day inpatient, residential or in custody substance abuse treatment program approved by the court; (2) not less than a 90-day outpatient treatment program approved by the court; (3) a drug court program approved by the court; or (4) any other substance abuse treatment program approved by the court. N. M. S. A. § 66-8-102(M).
