Treatment
- A person convicted for their first offense within a five-year period is required to complete a 14-hour minimum substance abuse rehabilitation program. HRS § 291E-61(b)(1).
- Whenever a court sentences a person pursuant to subsection (b), it also shall require that the offender be referred to the driver’s education program for an assessment, by a certified substance abuse counselor, of the offender’s substance abuse or dependence and the need for appropriate treatment. The counselor shall submit a report with recommendations to the court. HRS § 291E-61(h).
Marijuana use in vehicle
- Hawaii allows certain registered patients to use marijuana for medicinal purposes. A registered patient may not use marijuana in “any moving vehicle.” HRS § 329-122(c)(2).
