If at the hearing, the person is found to have been driving while intoxicated, or registered a BAC .08%, or refused the BAC test the driver’s license will be suspended for:
- 6 months for 1st offense DUI and/or 180 days for 1st offense Refuse Test
- Suspension for 2 years for a 2nd offense within 5 years
- Suspension for 30 months for 3rd offense within 5 years
- Revocation for 4 years for 4th offense DUI within 5 years
- Revocation permanently for 4th offense Refuse Test within 5 years
Offenses that occur in a motorboat will carry the same penalties as if the offense occurred in a motor vehicle.
Anyone who is charged with these criminal charges will also face penalties from the Department of Finance and Administration in the form of Administrative driver’s license suspension. This driver’s license suspension is separate from any criminal charges. In order to be challenged, a request for an administrative hearing must be made within 7 days of receiving a notice of driver’s license suspension. Failure to request a hearing will result in your driver’s license being suspended for 30 days from the date you received the notice. The number of your offenses will determine the length of suspension.
- First DWI/DUI Offense — License will be suspended for 6 months
- Second DWI/DUI Offense within 5 Years — License will be suspended for 2 years
- Third DWI/DUI Offense within 5 Years — License will be suspended for 30 months
- Fourth DWI/DUI Offense within 5 Years—Permanent license revocation
The court may determine that you need to complete an approved drug and alcohol education and/or treatment program. You must complete this program before you can apply to have your driver’s license reinstated.
