Arizona Extreme DUI
Extreme DUI applies to anyone with an alcohol concentration of 0.15 or higher
- Extreme DUI First Offense: Anyone with a first offense of Extreme DUI will be jailed for no less than 30 consecutive days and there is no eligibility for probation or suspended sentence. In addition, they will be fined no less than $2,500.00 and may also be required to take alcohol treatment. They may also be ordered to perform community service and to equip their vehicles with a certified ignition interlock device.
- Extreme DUI Second or Subsequent Offenses: Anyone with a second or subsequent offense Extreme DUI will be jailed for no less than 120 days and will be fined no less than $3,250.00. In addition, their license will be revoked for 12 months. They will also be required to take alcohol treatment and they must equip their vehicles with certified ignition interlock devices and will be ordered to perform community service.
Arizona’s Aggravated DUI
Arizona’s Aggravated DUI applies when a person commits:
- A DUI when their driver’s license is suspended, revoked or cancelled
- A DUI while a person under the age of 15 years old is in the vehicle
- A third DUI in 84 months
- Refuses to submit a blood alcohol content test while under the ignition interlock device requirement
For those who are charged with Arizona’s Aggravated DUI, you will be sent to prison for no more than two years. In addition, their license will be revoked for one full year. They will also be required to take a drug and alcohol treatment program and equip all vehicles they operate with a certified ignition interlock device. They will also be required to perform community service.
