Type of DUID Law: Under the influence

(1) A person commits the offense of driving under the influence of intoxicants if the person drives a vehicle while the person: …
(b) Is under the influence of intoxicating liquor, a controlled substance or an inhalant; or
(c) Is under the influence of any combination of intoxicating liquor, an inhalant and a controlled substance.
DUII is a class C Felony if the current offense was committed in a motor vehicle and the defendant has been convicted at least three times in the 10 years prior to the date of the current offense.

Marijuana in vehicle
- Oregon allows both the recreational and medicinal use of marijuana. State law, however, does not specifically address the use of marijuana in a vehicle. By January 1, 2017, the Oregon Liquor Control Commission has been directed to “examine available research, and may conduct or commission new research, to investigate the influence of marijuana on the ability of a person to drive a vehicle and on the concentration of delta–9–tetrahydrocannabinol in a person’s blood, in each case taking into account all relevant factors” and “present the results of the research, including any recommendations for legislation, to the interim committees of the Legislative Assembly related to judiciary.” 2015 Oregon Laws Chapter 614, § 172
