- In order to apply for restricted driving privileges after refusal of a chemical test, the driver must first obtain a substance abuse assessment from a mental health facility and successfully completed any recommended training or treatment program. N.C.G.S.A. § 20-16.2(e1).
- For Levels 3-5 punishment, if the defendant is placed on probation, the court must impose a requirement that the defendant obtain a substance abuse assessment and the education or treatment for the restoration of driving privileges. N.C.G.S.A. § 20-179(k).
