The Colorado DMV will revoke your driver’s license if you refuse to take a breath or blood test or if you have BAC results of 0.08% or higher. If you would like to challenge this charge, you must do so within seven days from the time you are arrested. During this seven day period, you have temporary driving privileges until the date of your hearing. If you lose the hearing, your driver’s license will be revoked immediately.
First a first offense, your revocation period will be 9 months. However, if you refused to take the BAC test, it will be for one year. You will only be eligible for early reinstatement if you choose to take the BAC test. If this is your second offense, you will receive a one year revocation. If you refused to take the BAC test, your revocation period will be two years.
It is important to recognize that the DMV hearing is completely separate from the criminal case that you are facing. The criminal case will determine other penalties, such as jail time and other sentence requirements that are determined by the criminal court judge. The DMV hearing will determine the revocation of your driving privilege.
